What You Need to Know About Your Digital Trail: Privacy in the Era of Datafication

In this era of increasing datafication, privacy and data protection issues are of paramount importance in the private and public sectors. Data privacy and protection matters include a broad range of concerns including, but not limited to, regulation, consent, processes, storage, and third-party access. In response to these concerns, several African countries have enacted data protection laws and created regulatory offices to oversee enforcement. These offices are critical in ensuring that users’ digital trails are protected from malicious actors and the data resulting from digital activities is not exploited. This is especially important in activities with monumental consequences such as elections.
Data protection is a key component of a functioning democracy. Data exploitation or manipulation constitute a serious threat to a fair, democratic electoral process and has the potential to undermine open debate, fairness and transparency which are essential in a democracy.
The development of micro-targeting advertisements, for example, from unlawful processing of personal data illustrate the challenges posed by modern technologies, and demonstrates the particular importance of data protection in the electoral context.
This panel will discuss the data protection enforcement challenges faced by the East and Central African countries and key actionable considerations. In light of the upcoming Kenyan and Angolan elections and recently concluded mayoral elections in Senegal, the panel will also discuss the footprint left by voters engaging in electoral processes; the ways in which data generated by voters is utilized; regulations enacted to protect electoral data, and enforcement strategies and gaps.

She is excellently versed in data protection and privacy legal aspects on data subject’s rights, data protection principles and consent-related matters as well as consent disputes. She has worked with various commercial entities on conducting data impact assessments, managing data breaches and developing Data Protection and Privacy Policies in compliance with industry-specific applicable laws and guidelines. Fatma currently works at Victory Attorneys and Consultants, a top commercial law firm based in Dar Es Salaam Tanzania. Notably, Fatma has been instrumental in drafting the Model Law on Data Protection and Privacy for the United Republic of Tanzania. She has also contributed to the drafting of several articles in the VAC Data protection Article Series authored by Victory Attorneys & Consultants. In addition to Santana Simiyu (Programme Officer @International Commission of Jurists - Kenya) Santana serves as the Programme Officer equality and inclusion, civic space, digital rights, and independent media. She is a human rights lawyer with a passion for constitutional law. Before joining the ICJ team, she worked in two law firms: Asiema and Amadi Advocates and Mauncho and Company Advocates, and did her pupillage at the Attorney General's office. She dedicates most of her time to conducting advocacy, research, project design, and implementation. Santana Simiyu is an advocate of the High Court of Kenya. She holds a bachelor's degree in law (LLB) from the Catholic University of Eastern Africa and a Postgraduate Diploma from the Kenya School of Law. Rahab Magiri Juma (Advocate of the High Court of Kenya ) Ms. Juma is an advocate of the high court of Kenya with over 5 years of experience in ICT industry spanning from Privacy and Data Protection, Public Policy and Administration as well as Corporate Governance and Regulatory Reform. She has had the privilege of serving as a member of the Working group on the Development of Policy and Regulatory Framework on Privacy and Data Protection that developed the Data Protection Policy 2018 and the Data Protection Act No.24 of 2019. She holds a Post Graduate Diploma from the Kenya School of law and a Bachelor of Law (LLB. Hons) from University of Nairobi. Ms. Juma is a Certified Company Secretary, an associate member of the Institute of Certified Secretaries (ICS), and is currently pursuing her LLM in ICT Law. Baker Birikujja (Manger Licensing and Legal Affairs @Personal Data Protection Office) CIPP/E and CIPM legal professional skilled in data protection and privacy, technology regulatory compliance, digital transformation contracting and project management. Grace Mutung'u (Researcher on Tech Policies in Africa ) Grace is a researcher on tech policies in Africa. Her interests include digital transformation, content policy, data governance and digital ID. She has written and participated in shaping laws and regulations on elections and technology in Kenya. Grace is also coordinating Open Society Foundation's digital ID working group and is based in Nairobi, Kenya Victor Kapiyo (Partner @Lawmark Partners LLP) Victor is a lawyer practicing in the Kenyan Bar, a Human Rights Defender, a Researcher, and a Tech-enthusiast.
