For decades, the TAB fixed price contracts have had a materials escalation clause. Until now, builders have not had to rely on this provision - that has changed. Prices of lumber and many other materials have skyrocketed. Don Shelton with Bush Rudnicki Shelton, PC, one of the primary authors of the TAB contracts and a TAB Contracts Committee Member, will explain how to use this provision effectively, the calculations, timing, enforceability, how to deal with resistant owners and lenders, the commodities covered by the clause, and the technical details in the application of the clause.
