Trying a Case Backwards
The most effective way to succeed at trial is to conduct it backwards: as soon as you get the case, look at the claims or defenses you will present, get the elements of the claims or defenses, and then think about what you will say in your closing argument. Doing so will then help you: best frame your claims or defenses; plan and focus discovery; get critical phrases you want to use in a deposition to get trial testimony; plan dispositive motions and motions in limine; and jury instructions.
