Going Virtual for Good: Lessons from International Arbitration
Following the lockdown of courthouses around the world, videoconferencing was deployed rapidly to support the key role previously played by in-person hearings, and to keep the wheels of justice turning. We are gaining experience with virtual hearings and attitudes are changing toward this ‘temporary substitute’ and to whether it might play a continuing role in the post-pandemic era. This raises a host of questions for proceduralists. Are virtual hearings changing the way we experience civil justice and altering the nature and balance of our core procedural values? Will they exacerbate or ameliorate the digital divide? How can we make them meaningful and accessible to participants? What can we do to ensure that if this trend is ‘for good’, it will also be for the better? Inspired by the memorable lectures of Professor Michele Taruffo, this lecture seeks to provoke thought on one of today’s important issues of procedural justice.
