Business interruption? Health & Safety? Corporate Manslaughter? Mental Health? Coronavirus has brought fundamental change to the relationships health and social care providers have with both their employees and those they treat and care for. Out of that change complex issues have emerged, compounded by uncertainty and a rapidly changing environment in which hospitals, care homes, community social care providers and charities are currently operating. Having dealt with the initial critical phase and flattened the curve, providers are starting to see claims being initiated. Having taken extensive steps to safeguard employees, patients and service users, the focus may now need to turn to defending such claims, insuring the liability and actively preventing new ones. This will be time consuming and potentially costly to manage when resources are stretched and the primary focus is delivering services rather than defensive action.
