Section 13(b) of the FTC Act has become a mainstay of the agency’s enforcement program. But now the FTC’s authority to obtain monetary relief for victims pursuant to 13(b) is being challenged. On Jan. 13, the Supreme Court will hear oral argument in AMG v. FTC, a case that will determine whether or not the FTC has the authority to seek equitable monetary relief.
