How should districts address initial evaluation team reports that are required to be completed within 60 days (60 days will expire within this 3 week span of no school) when record reviews are not applicable?

We have very strong union language indicating that teachers are not required to work at home...any suggestions?
I can see the legal battles when parents realize their child was not given compensatory services but aniotehr child was given compensatory services, While we can rely on the IEP, parents may not agree with what isa subjective call. This could be time consuming and creat legal battles. Will there be a standard that we can rely on?
Questions about formal complaints: 1. Does a pandemic qualify as an "exceptional circumstance" which allows extension of the 60-day timeline? 2. If state offices are closed or staff is asked to telecommute, how does this impact timelines since mail can't be checked if the building closes?

So if an elementary school is closed but e-learning is taking place, then PS services are not required. Is that correct?
We are a virtual school....how do we handle completing face to face testing for the ETR (Psychologist testing...) if we cant complete testing before our timeline (initial or reeval)?

If there are school closures, and the school is providing some type of virtual learning opportunity, what are the responsibilities for speech therapy, OT, and PT? Are these people expected to provide services in the home? We are located in a large state and the Speech Therapist, OT, and PT see students in many school districts over a large mileage area. What are some other options?
Are there HIPPA or FERPA laws regarding types of virtual instruction provided?

When schools are closed, but distance learning options are being provided, does the Evaluation timeline (Initial or 3year) for students stay the same, or does the team have extended time to complete these evaluations.

A OOD school has asked if they can be paid full tution daily rate even when they are providing a very modified- limited program? In Mass OSD sets the daily rates. Who decides this?

Bottom line, Do IEP service minutes need to be matched exactly as written in the IEP if the district is closed and has determined to proceed with online learning.

For our students who may have intensive needs and goals are for example, feeding. How could we address this? This is not something that we can truly work on
vague answers as I am sure there are more questions than answers-- since we are all in the same boat I hope State Education gives us some relief on services and timelines. As there are no clear cut guidelines for us.
if we have to have all these IEP meetings after we return to consider comp time, how realistically can we at the point of the spear do this and still give services to students when they return? May be logistically impossible. Please consider this at OSEP.
For the future, will there be forms developed for the IEP to address Distance Learning for extended school closings?
When do you expect the timeline questions to be answered? Since our staff members are leaving the district next week they will request these questions to be answered so they are prepared.

if school closed wouldn't those days be readjusted on evaluation timelines; and with IEP adjustments for annual reviews..
Please consider for the time line discussion: There is local Dept. of Ed guidance for schools not go past the required 185 days of school, two weeks of closure would reduce the physical number of days to legal timelines. Districts only have so many hours in a day/days in a week for the remainde rof the year. This is a concern.
***So, basically, is we do not require any distance learning from general ed students, we do not have to provide to students with disabilities?
If we are considering moving services to virtual online learning, will IEPs need to be amended to reflect this? Is meeting with the parent, and providing an outline, in writing how services will be provided, sufficient?
If parents arrange for services with private provider at alternate location, can district reimburse parent and count that as service under IEP?
It is likely that progress monitoring during the closure will show regression for many students. Will additional funds be available to help districts extend ESY services to a larger number of students?
So is the guidance that if we close for a few weeks we need to reconvene on EVERY student to determine if compensatory services are required? that becomes a capacity issue

I am sorry, this may have been addressed. Is this being recorded? We are a virtual school, so SDI and services are covered. However, evaluations (which are face-face) will be impacted with ability to meet with students. Will this be accommodated?
If a student receives speech services only, is the provider required to send home activites related to these services during the closure?
Must the determination for the need for comp. ed. be made by the IEP Team. In other words, are we contemplating reconvening IEP Teams for all IEP students on return from the school closure to determine the need for compensatory services (and if so, how should such determinations be documented - on the IEP or through an IEP Amendment)?
If an elementary school is closed with e-learning, are we obligated to provide preschool services that are in the Pre-K IEPs?
Can you explain the LEA responsibility to private schools that are in session when the LEA is closed?
If the district is extended spring break and not sending any work home with students, is it required that students with special needs receive services listed on their IEP's?

Indianapolis has waived 21 days of school for school districts - does this waive services for these days? Weeks?

If a system provides online instruction as enrichment for parents and students and not as required work or instruction that will be graded, will this be considered as not providing any educational services to general ed student so that services do not have to be provided for special ed students?
