The documents are in the email that came about this webinar
Erin Lawson
01:27:02
I hope questions regarding re-evaluation and annual deadlines will be addressed (REEDs /consent just prior to school closing
LeeK1
01:27:03
So, who would we address the issue if a student in gen ed setting does not attend the provided platform with resources provided to attend, are we then responsible for considering comp time?
Lorain City Schools
01:27:13
Great question rhoot….also, what if we do not have hardware or for students who cannot access this hardware independently
hzimmerman
01:27:35
IF Local district is closed by an OOD placement remains open can District still allow OOD stduent to attend?

Define Educational Services
Meredith
01:28:24
How should districts address initial evaluation team reports that are required to be completed within 60 days (60 days will expire within this 3 week span of no school) when record reviews are not applicable?
rhoot
01:28:33
I also would like to know how other Directors are handling annual reviews, re-evaluation timelines and initial l referral timelines-- we need some relief.
SueAnn Bube
01:28:44
If the State waives school days, are IEP Teams still required to ensure FAPE equal to the normal operations?
Lorain City Schools
01:29:15
We have very strong union language indicating that teachers are not required to work at home...any suggestions?
hzimmerman
01:32:23
I can see the legal battles when parents realize their child was not given compensatory services but aniotehr child was given compensatory services, While we can rely on the IEP, parents may not agree with what isa subjective call. This could be time consuming and creat legal battles. Will there be a standard that we can rely on?
sstarkey
01:33:14
Questions about formal complaints: 1. Does a pandemic qualify as an "exceptional circumstance" which allows extension of the 60-day timeline? 2. If state offices are closed or staff is asked to telecommute, how does this impact timelines since mail can't be checked if the building closes?
jennifermeyer
01:35:09
YES!!! Great question SStarkey!
shawna.dippman
01:36:09
If we do opt to use telehealth and/or virtual services during the break period, will that count toward offers of FAPE? If yes, how much time will count and what documentation would be required to show the delivery of those services? Thank you.
pambell
01:37:37
So if an elementary school is closed but e-learning is taking place, then PS services are not required. Is that correct?
Kristal Lockwood
01:37:42
We are a virtual school....how do we handle completing face to face testing for the ETR (Psychologist testing...) if we cant complete testing before our timeline (initial or reeval)?
hzimmerman
01:37:50
to follow up - must the provider be approved as a teelhealth provider by insurance or medicaid for this to happen?
Owner
01:37:50
If there are school closures, and the school is providing some type of virtual learning opportunity, what are the responsibilities for speech therapy, OT, and PT? Are these people expected to provide services in the home? We are located in a large state and the Speech Therapist, OT, and PT see students in many school districts over a large mileage area. What are some other options?
Shannon
01:38:25
Are there HIPPA or FERPA laws regarding types of virtual instruction provided?
Connie
01:38:36
Related services are still to be provided also, correct?
Malinda Pennington
01:39:09

When schools are closed, but distance learning options are being provided, does the Evaluation timeline (Initial or 3year) for students stay the same, or does the team have extended time to complete these evaluations.
Lindsay Aronheim
01:40:03
Will you be providing a document that has the chat questions and answers?
gbodrie
01:40:07
What about required timelines during a schoolwide shutdown- Initial and re-evaluations and annual IEPC's
janan.zimmerman
01:40:11
Do we need to provide FAPE to special ed if school is sending home packets to all students for practice and not expecting completed documents returned?
lily
01:40:29
Yes. a summary of the questions in this chat stream and the answers would be SO helpful.
Kimberly Shoup
01:40:34
For clarification, if a student is out along with their GE peers for more than 10 days due to an ALL school closure, we still need to reconvene an IEP upon school resuming to review if current programs and services continue to meet needs or if compensatory services or ESY are needed. Is this correct?
hzimmerman
01:40:56
A OOD school has asked if they can be paid full tution daily rate even when they are providing a very modified- limited program? In Mass OSD sets the daily rates. Who decides this?
pambell
01:41:02
Does a packet being sent home count as IEP minutes? Don’t we need to provide interaction of some sort?
jbullinger
01:41:07
Appreciate guidance regarding compliance with timelines during school closures such as annual reviews, re-evaluation timelines and initials.
Kristal Lockwood
01:41:11
we do virtual related services through a contractor but it is able to be done.

On QA-1, one paragraph says "educational services" and the next says "educational opportunities". Is there a distinction between the two?
kathleen.lynch
01:41:39
Can the question be restated having difficulty hearing Ms. Williams
Nancy
01:41:51
What about the students who require an IEP within 364 days? We will be reconvening IEP meetings when schools reopen however some will be out of compliance. Will be flexibility be given?
Kristal Lockwood
01:42:02
who will that affect our funding and report cards?
kathleen.lynch
01:42:06
Yes
JBurke
01:43:13
That was my original question... is sending work home as precautionary measure considered educational services?
jacksonausperk
01:43:19
If our preschool teachers are all licensed Early Childhood Intervention Specialists, and they are providing all of the materials for their students, does that cover SDI?
Lorain City Schools
01:43:28
How do you do that In 2 days?
Sean Brost
01:44:02
Is there a plan to address student work hours/job training for OCS students if LEA is closed?

Can you elaborate on the definition of "instructional telephone call"
heather.desrochers

If related services are not required during a shutdown, are they mandated to be made up?
dscarpucci
01:45:46
When will timeline guidance be available. We have deadlines starting Monday but were closed by Governor.
Kristal Lockwood
01:46:10
how will this affect AASCD testing if we are not able to complete it before the Mrach 27th deadline?
tnpittman
01:46:15
Must web/telephone based instruction be equal to service delivery frequency and duration specified in the IEP?
sbaker
01:46:47
If an out of district placement is closed, but the home school district is open, what is the requirement for providing services to those students placed outside of the district?
karen
01:48:21
Bottom line, Do IEP service minutes need to be matched exactly as written in the IEP if the district is closed and has determined to proceed with online learning.
Stuart Clark
01:48:39
Are you planning to provide guidance on having compensatory service discussions during IEP meetings when school resumes? Specifically some guiding questions to help teams have comprehensive conversations.
LeeK1
01:49:16
For our students who may have intensive needs and goals are for example, feeding. How could we address this? This is not something that we can truly work on
rhoot
01:49:19
vague answers as I am sure there are more questions than answers-- since we are all in the same boat I hope State Education gives us some relief on services and timelines. As there are no clear cut guidelines for us.
brett.horvath
01:49:43
if we have to have all these IEP meetings after we return to consider comp time, how realistically can we at the point of the spear do this and still give services to students when they return? May be logistically impossible. Please consider this at OSEP.
sepplin
01:49:45
For the future, will there be forms developed for the IEP to address Distance Learning for extended school closings?
Meredith
01:49:49
When do you expect the timeline questions to be answered? Since our staff members are leaving the district next week they will request these questions to be answered so they are prepared.

01:50:27
If a child is on homebound, is there still an obligation to send a teacher into the home?
Lorain City Schools
01:50:28
Meredith -- our teachers are leaving Monday
Nancy W Dugan
01:51:04
if school closed wouldn't those days be readjusted on evaluation timelines; and with IEP adjustments for annual reviews..
htucker
01:51:37
Please consider for the time line discussion: There is local Dept. of Ed guidance for schools not go past the required 185 days of school, two weeks of closure would reduce the physical number of days to legal timelines. Districts only have so many hours in a day/days in a week for the remainde rof the year. This is a concern.
cspringer
01:52:20
***So, basically, is we do not require any distance learning from general ed students, we do not have to provide to students with disabilities?

01:52:45
If we are considering moving services to virtual online learning, will IEPs need to be amended to reflect this? Is meeting with the parent, and providing an outline, in writing how services will be provided, sufficient?
hzimmerman
01:53:45
If parents arrange for services with private provider at alternate location, can district reimburse parent and count that as service under IEP?
tnpittman
01:53:47
It is likely that progress monitoring during the closure will show regression for many students. Will additional funds be available to help districts extend ESY services to a larger number of students?
alice.brown-legrand
01:53:47
So is the guidance that if we close for a few weeks we need to reconvene on EVERY student to determine if compensatory services are required? that becomes a capacity issue
jfriend
01:54:06
Would the team need to meet virtually to determine if the homework packet would meet educational services before the service is provided?
bjcatanzarite01
01:54:58
I am sorry, this may have been addressed. Is this being recorded? We are a virtual school, so SDI and services are covered. However, evaluations (which are face-face) will be impacted with ability to meet with students. Will this be accommodated?
Nancy
01:55:10
If a student receives speech services only, is the provider required to send home activites related to these services during the closure?
jbullinger
01:55:45
Must the determination for the need for comp. ed. be made by the IEP Team. In other words, are we contemplating reconvening IEP Teams for all IEP students on return from the school closure to determine the need for compensatory services (and if so, how should such determinations be documented - on the IEP or through an IEP Amendment)?
pambell
01:55:45
If an elementary school is closed with e-learning, are we obligated to provide preschool services that are in the Pre-K IEPs?
ddeperro
01:55:54
Can you explain the LEA responsibility to private schools that are in session when the LEA is closed?
longfellow
01:56:28
If the district is extended spring break and not sending any work home with students, is it required that students with special needs receive services listed on their IEP's?
jthompson
01:58:10
Could the questions and answers be typed up and shared with the recorded video link so that we can reference it rather than watch the video again?
rhonda_mcclenahan
01:58:45
If the homebound student is sick and the homebound teacher is not able to provide that service would the LEA owe comp ed for that time
KCheslock
01:59:01
When can we expect the information specific to the timeline and timeframe questions? We have 2 days and our buildings are shut down.
James Bever
01:59:35
I’d like to suggest to the national organizations that you produce and disseminate an FAQ based upon the answer provided to the questions herein. That would be MOST helpful.
dscarpucci

02:05:39
This is the opposite of a question that was previously asked:If an out of district placement is closed, but the home school district is open, what is the requirement for providing services to those students placed outside of the district?

If a system provides online instruction as enrichment for parents and students and not as required work or instruction that will be graded, will this be considered as not providing any educational services to general ed student so that services do not have to be provided for special ed students?
