Alison Heard
33:48
Can a 2 week Christmas closure period be counted as part of Directive leave
Alison Fryer
40:20
can we still pay a % on top of the hourly rate ?
Ann Wall
41:39
what should we do for staff who have a contract PT or FT who work additional hours? should they get holiday pay on the additional hours?
Ann Wall
41:52
what is regular basis?
Lorraine Smalley
43:07
What denotes as being 'regular' overtime? Thanks
Karen Gardner
43:50
We have some casual staff who have not worked since March 2020, do we have to pay any holiday pay for the 20/21 academic year?
Judith Alcock
44:11
can we make the payment as an additional payment.
Tonia Van Der Zyden
45:28
we pay a % on top as holiday pay which we pay termly (when we are closed to students) is this ok?
Dal Youssef
45:58
With regard to casual staff, can we pay their holiday pay at College closure periods. The holiday pay is calculated based on the hours worked that term, and we add the holiday percentage to the hours worked
Daniel Sibly
47:15
we are in the same situation as the question 'Tonia van der zyden' asked above..
Kylie Stroud
48:22
So are we - for our teaching staff. For our casual waiting staff, we roll up the % in their pay
Dal Youssef
49:14
Yes
Ann Wall
49:51
i think some scenarios with explanations of what 'should' be happening might be useful as I think we're all doing it a variety of ways
Dal Youssef
50:22
That is right, thank you
mary vine-morris
53:02
Thanks everyone - will try and cover as many questions as possible. Apologies if yours isn't fully covered. Raise it again at the end.
Judith Alcock
55:40
We make a separate payment for holiday as an additional payment on all overtime, timesheet and lecturing hours paid. is that ok
Karen Fleet
58:43
Does the brazel case change the holiday pay rate calculation for agency workers? is paying 12.07% unlawful?
Vicky Owen
59:00
We have people who work less than term time i.e. 9 weeks a year. Are we really expected to pay them 5.6 weeks holiday pay?
Camilla Holland
01:02:33
Re the Brazel case - Can I check that this only applies to permanent contracts? If someone is on a ftc for 11 months does it allow us to calculate a salary based on 40 week plus a holiday factor (of 5.3 weeks)
Cecilia Asebi-Antwi
01:04:13
Our TTO staff work 39 weeks but get paid 44 weeks (the additional weeks is their holiday entitlement), and this is paid over the year in 12 monthly payments. If they fall sick over the college holidays, can they claim their holiday back even though they've already been paid it?
Ann Wall
01:06:53
That will only apply to new contracts issued?
Richard Cockerton
01:08:28
Re. Term time contracts - how should holiday pay / time off accrual work for a 12 month maternity leave period? - does the member of staff take the time off in term time or can it be accounted for during college closure date?
Karenb Lock
01:10:51
have the same question as Richard on term time only maternity leave and holiday
Cecilia Asebi-Antwi
01:12:12
thank you
Richard Cockerton
01:13:29
Thank you - I had a feeling that might be the case :-/
Anthea Scowen
01:13:41
Will the AoC issue a new TTO Calculator based on the current legal position?
Jeannette Young
01:13:46
Thank you - really interesting and helpful.
Cecilia Asebi-Antwi
01:14:20
When will the new contract templates be available?
Karenb Lock
01:15:50
So if someone works less than full time and is not term time only we can pro rate the leave, but if they are term time only we can't?
Helen Deason
01:15:57
Is it possible to pay a payment for accrued holidays for long term sick to mitigate a reduction in salary?
Richard Cockerton
01:17:19
Thanks everyone for this - a very useful session.
Liz Elwell
01:17:43

Judith Alcock
01:18:03
We make a separate payment at an additional rate
Camilla Holland
01:18:24
Thank you for your answer to the first question.Another thing to check (sorry) - our teacher contracts start on 1 August (for the second year of employment) is this normal? (This means by the end of half-term the directive four weeks have been used up).

If a TTO employee starts part way through the holiday year can the amount of holiday be adjusted for the remaining holiday year.
