Agree of course, the legal framework is geared to protect corporate actors not hold them accountable. The legal framework just exists so that corporates don't overstep the line of doing heinous acts so overtly. But then how can laws change if corporations influence institutions, governments and law making?

To all, visit our site at corporate-crimes.org

01:11:43
Please discuss at some point the balance of incentives — corporate criminal liability for the entity vs for the executives — and the possibilities as well as limits of both in terms of achieving the purposes of legal remedy/accountability.

01:24:19
Do we need to change the discourse - emphasis the social harms that result from irresponsible corporate behaviours?

01:25:54
We have to remember that corporations do not act independently of the human beings behind the veil. Corporate impunity is a byproduct of a dominant culture in society.

01:29:14
Thank you so much, Agnes.

01:34:59
there's no sound for me

01:35:10
There is no sound

01:42:01
agree its about political will at national level to combat impunity as with so many rights issues

01:42:53
rather than default position of going for another international treaty although could give some impetus as Anita says

01:57:36
But how real is the separation between corporate and state when viewed through the lens of national interests in the manifestation of political will?

02:00:01
yes please lets see investigators target boardrooms

02:03:04
like all crimes you need the deterrence effect as Seema says

02:04:02
Instead of trying to infiltrate the board rooms it would be far easier to protect whistleblowers properly. Most assistants, secretaries, interns would inform on what is going wrong, if they would be protected. Maybe the NGOs could start a whistleblower protection scheme, providing the money till national legal systems catch up?

02:04:49
Perhaps we can use their tools against them and create companies to challenge and facilitate hostile takeovers.

02:11:00
@Julia Thrul, in Mexico for example, we at PODER are coordinating a group of CSOs working precisely on whistleblower protection. We have also co-developed leaking platforms in Mexico, Perú, Chile, Guatemala to receive information.

02:14:42
Hello all, I am posting the link to FIDH's Guide on Corporate Accountability : corporateaccountability.fidh.org

02:16:25
excellent point on whistleblowers

02:28:56
Very worryingly, in connection to allegations of corporate corruption, two Congolese whistleblowers were recently sentenced to death by the Congolese court in absentia. This is potentially a very dangerous precedent unless quashed. Thankfully these individuals are not currently in the DRC.

I think organizing is the way to move forward, building alliances between communities, CSOs, social movements, journalists, academics, and hopefully prosecutors.

02:48:00
