Changes in Expedited RemovalICE recently announced changes in their “expedited removal” process. Before, when ICE arrested someone in the interior of the country, the person had the right to a hearing with an immigration judge. However, the immigrant has to prove that they have been here for more than 2 years. It seems that people who entered after July 23, 2019 will also not be affected if they can show that they have been here since that date. We do not know if ICE will start to arrest more people. The new information is that if ICE does encounter someone, now we need to be prepared to show that we have been here for 2 years.
How to prove two years of presence:Make a packet of COPIES (not originals) of documents with your name and the date that show that you were in the US, for example:Bank recordsSchool, medical, or church recordsPaystubs or work recordsRecords of contact with the police (only if you want ICE to see it! Not about your arrest)Birth certificates of children who were born in the USAReceipts, billsLeaseMailTaxesPhotos (if they have the date and it is clear they are in the US)Don’t include any document you don’t want ICE to see. For example, nothing with a false social security number, nothing that shows you were born in another country.Carry a copy with you. Keep another copy in a safe place. Keep originals in a safe place.Prepare! Gather these documents now!
What should I do if I encounter ICE?Say: “I want to remain silent. I want to call a lawyer. Am I free to go?”You DO NOT have to answer ICE’s questions. It is ICE’s responsibility to prove that someone is not from the United States. The most common way they prove this is that the person tells them!DO NOT say what country you are from. DO NOT say you are not a U.S. citizen.DO NOT lie (for example, you also should not say that you ARE a citizen, if you are not)DO NOT show the packet proving you have been here for 2 years, unless ICE says they are subjecting you to expedited removal.
