What about security guards who are only hired during an event or services. Since the building is closed and they are paid on an as needed basis, would they be considered laid off if we don’t pay them?
I've heard one possible interpretation that $100k+ employees are counted for the loan amount up to $100k, but that portion may not be forgivable.
Leslie - I think if you hire them before June 30th, it would not affect the forgiveness. As to the loan application, I think the inability of being able to hire is an example of your need.

I do not believe you would include 1099 contractors because they are not "employees". "Employee" is a very specific connotation. FT and PTers only.
note - 1099 contractors are addressed in the resource linked above. “Payroll Costs includes compensation to employees, such as salary, wage, etc.; paid leave; severancepayments; payment for group health benefits, including insurance premiums; retirement benefits; stateand local payroll taxes; and compensation to sole proprietors or independent contractors (includingcommission-based compensation). On Page 30 – paragraph Q Duplication – this talks about nothing shall prohibit recipient of a EIDL for a purpose of other then paying payroll costs and any other obligation noted in Paragraph (F) (Sec Question 2 above) from receiving a PPP loan. Is this saying that if you receive a EIDL to cover costs such as Rent, Utilities and Loan Interest you are ineligible for a PPP loan even though in computing the amount of a PPP loan only labor costs are allowed ?
